By using edsurfing, a social network dedicated to mentoring and learning, you agree to comply with the following terms and conditions. These terms are effective from the date of your first registration in edsurfing, whether it involves listing a mentoring opportunity, booking a mentoring session, creating a profile page or participating in our learning community and all other activities in the service. Please note that individuals under the age of 16 may need to obtain the consent of their caregivers before using our services.

Platform Purpose

edsurfing provides a platform where mentors can create "ed-lessons" and "ed-events" to offer teaching services online or in person, and where learners can create "learning topics" to express their educational needs. Additionally, edsurfing fosters an environment where users can find new connections, engage in learning, and make new friends in a transparent and supportive community.

Payments

Learners pay edsurfing, which then deducts a 15% commission fee before transferring the remainder to mentors. Payments remain in "pending" status for 7 days for financial processing before mentors can withdraw the funds. Learners are also subject to a 5% service fee when ordering ed-lessons and ed-events. Payouts to mentors may have additional deductions based on bank or payment service transaction fees.

Visibility of User contents

User profiles, as well as ed-lessons, ed-events, and learning topics, including their pictures are publicly visible to all edsurfing members and customers. This information may also be accessible to users outside of our platform, such as visitors to our website or third-party search engines and others and can also be used in social medias and other channels for promotional purposes of edsurfing and members. This transparency aims to foster learning, participation in ed-events and ed-lessons, and the creation of new connections, which are core objectives of edsurfing.

Contact and Social Media

"contact and social media" section is visible to edsurfing premium members and individuals in member’s friend list. Mentors' contact and social media information is also accessible to users who have purchased ed-lessons or ed-events from them. This is to let learners having deeper connection with the mentors they are going to have a teaching session with.

Data Deletion

Users have the option to delete the information they enter in edsurfing, including their profile infromation, ed-lessons, ed-events or learning topics. However, note that ed-lessons and ed-events with participants cannot be deleted from edsurfing. This restriction is in place to allow learners to keep track of their learning experiences and ensure transparency on the platform.

Tax Transparency

Fees stated by mentors must be inclusive of VAT and all other applicable taxes, charges, and expenses. As a mentor, you are responsible for paying any income tax, VAT, social security contributions, and all other taxes related to your income, regardless of where the tax obligation arises. Additionally, please note that edsurfing is not responsible for any permits required for holding any type of teaching sessions.

User Relationship

When you create content on edsurfing and provide ed-lessons or ed-events, you understand and agree that your relationship with edsurfing is limited to being a user and an independent, third-party contractor. You are not considered an employee, agent, joint venturer, or partner of edsurfing for any reason. You act exclusively on your behalf and for your own benefit.

Refund policy

By booking an ed-lesson or ed-event, you consent that the funds are non-refundable unless you report a valid teaching problem or complaint in accordance with edsurfing regulations.

Content guidelines

Avoiding publishing, posting, transferring, distributing, or uploading any content or information that is false, misleading, promotes illegal activity, is racially or ethnically offensive, constitutes defamation, contains pornography, attacks sexual orientation or religion, or is in any way harmful, abusive, offensive, or infringing on the rights of third parties, such as copyright and trademarks.

Responsible content upload

You may upload links, written comments, data, text, photos, graphics, and other information to the Website. You are fully responsible for any content that you upload to the Website. All the the contents must follow the content guidelines in 9.

Prohibited Activities

By using edsurfing, you agree to adhere to the following rules and guidelines:

  • Do not create a false identity on edsurfing, misrepresent your identity, or create a Member profile for anyone other than yourself (a real person).
  • Do not use fake name and and fake profile picture. Users must use their real names and real pictures in their profiles.
  • Do not use or attempt to use another user's account.
  • Do not create, assist with, or utilize software, devices, scripts, robots, or any other method to extract or duplicate profiles and other data from the platform. This includes using crawlers, browser plugins, add-ons, or any other technology for this purpose.
  • Do not override any security feature or attempt to override any security features or bypass access controls and usage limits of the platform.
  • Do not post content that contains harmful software, viruses, worms, or any other destructive code.
  • Do not use automated methods or bots to access the platform, add or download contacts, or send or redirect messages.
  • Do not monitor the availability, performance, or functionality of the platform for competitive purposes.
  • Do not engage in activities that simulate the appearance or function of the platform, such as "framing" or "mirroring."
  • Do not alter or modify the platform's appearance or function by inserting elements into the platform or removing, covering, or obscuring advertisements included on the platform.

Change of Terms and Termination of Services

We reserve the right to make changes to these Terms of Use. Information about such changes will be provided through clear notices on your account pages or by email to the address provided by you.

Intellectual Property Rights

Users should respect intellectual property rights and not post, share, or distribute content that infringes upon copyrights, trademarks, or other intellectual property. Any user-generated content remains the property of the user, but edsurfing retains a license to use it for platform-related purposes.

Security and Privacy

Users are responsible for maintaining the confidentiality of their login credentials and ensuring the security of their accounts. We have a Privacy Policy in place to outline how personal data is collected and used, and by using the platform, users consent to the terms of this policy.

Liability Limitations

edsurfing disclaims liability for any damages or losses resulting from using the platform. Users agree that they use the platform at their own risk. This clause can specify the extent to which edsurfing is liable or not liable for certain types of losses or damages.

Termination of Accounts

The platform reserves the right to suspend or terminate accounts that violate these terms and conditions or engage in harmful or illegal activities.

Dispute Resolution

In the event of conflicts or disputes arising between users and edsurfing, the parties agree to engage in a structured dispute resolution process. This process may include mediation, arbitration, or any other mutually agreed-upon method for addressing and resolving disagreements, with the aim of reaching an amicable resolution.

Governing Law

These terms and conditions shall be governed by and interpreted in accordance with the laws of Sweden, without regard to its conflict of laws principles. Any legal actions or proceedings arising out of or in connection with these terms shall be exclusively brought in the courts of Sweden.

User Acknowledgment

By using the services provided by edsurfing, users acknowledge that they have carefully read, fully understood, and agree to abide by these terms and conditions. Users explicitly consent to the rules and obligations outlined herein.

Entire Agreement

These terms and conditions constitute the entire agreement between users and edsurfing, superseding any prior agreements, understandings, or arrangements, whether oral or written, regarding the subject matter herein. Users acknowledge that they rely on these terms exclusively to govern their use of the platform.
